SR-22 Insurance in Maine: Triggers, the Three-Year Rule, and How to File
Published October 14, 2026
Maine requires proof of financial responsibility, filed by your insurer on a form called the SR-22, before the Bureau of Motor Vehicles will reinstate a license after certain suspensions. The clearest triggers in Maine law are a second OUI conviction within ten years, an accident-related suspension, and an unpaid judgment from a crash. Once the requirement attaches, Title 29-A says you must maintain the proof for at least three years. Here is how Maine's version works, what counts as proof, how your insurer files it, and what the BMV charges for the paperwork.
What the SR-22 is in Maine
Maine's Secretary of State describes the form as the SR-22, the Uniform Financial Responsibility Certificate of Insurance, and its counterpart as the SR-26, the Uniform Financial Responsibility Notice of Cancellation or Termination. The insurance company files both. When the BMV announced electronic filing in March 2022, it explained the stakes plainly: without proof of financial responsibility on file, drivers who have served their suspension are not able to have their driver license reinstated. The filing is a condition of getting the license back, not an extra step after.
Under 29-A M.R.S. section 1605, proof can be given by filing a certificate from an insurance or surety company with the Secretary of State, by depositing money or securities, or, for certain utilities, by showing financial ability to comply. For an ordinary driver, the insurer's certificate is the route, and a qualifying policy must include a condition requiring the insurer to satisfy a covered judgment within 30 days of rendition of judgment.
Who has to file in Maine
Maine's statute never uses the term SR-22; it refers to proof of financial responsibility. Section 1603 of Title 29-A lays out when the Secretary of State demands it:
- A suspension based on a conviction or adjudication for certain offenses, where the license is not reinstated until the person gives proof of financial responsibility under section 1605.
- An OUI conviction when the person has been previously convicted of OUI within a 10-year period. Section 2487 repeats the rule: a person with an OUI conviction within the 10-year period may not have a license reinstated until they have complied with section 1605.
- An accident, after which the Secretary of State may suspend a license or registration until proof is given for a period the Secretary requires.
- An unsatisfied judgment from an accident that caused bodily injury, death, or property damage of at least $1,000 and was not reported as required. Prior to restoration, the owner or operator must provide proof of financial responsibility.
Notice what the statute keys the OUI trigger to: a prior conviction within ten years. A first offense with no prior is not named in that subsection. If your case is a first OUI, ask the BMV directly whether a filing is being demanded in your case rather than assuming either way. The Driver License Services Division handles those questions.
How long you keep it
Section 1603 says that after reinstatement, the person shall maintain proof of financial responsibility for at least three years, and it allows the Secretary of State to waive the demand for proof after three years from the date of demand. Read those together: three years is the floor, the waiver is discretionary, and the clock the BMV uses runs from its demand, not from your conviction or accident date. Your suspension notice is the document that states your own dates. Neighboring Vermont counts its period differently, with the SR-22 in Vermont running three years from the event that caused it, so do not borrow a date from another state's rule.
Maine's minimum coverage
Maine's required limits are higher than most states'. Section 1605 requires at least $50,000 for injury to or death of one person, $100,000 for one accident injuring or killing more than one person, and $25,000 for property damage, plus $2,000 in medical payments coverage under section 1605-A and $500 for towing and storage charges under section 1605-B. A policy that meets these limits satisfies the proof requirement. Whether you want higher liability limits than the minimum is a separate question about what you have to protect.
How the filing works
Your insurer files the SR-22 electronically. The BMV's page tells you to have your insurance company file at tylerinsurancefilings.com and says online filings are accepted faster than the fax route carriers used before 2022. The BMV page lists no fee for the filing itself; what it charges for is paperwork. A copy of the letter showing your requirement or judgment suspension costs $5, and having it faxed back adds $2, payable by check or money order to Secretary of State. Written requests go to the Bureau of Motor Vehicles, Driver License Services Division, 29 State House Station, Augusta, ME 04333-0029, with your name, date of birth, current address, and the type of information you need. The phone line is 207-624-9000, ext. 52108.
The premium is a different matter. The SR-22 is only a form; the OUI, accident, or judgment on your record is what changes the price. Shop several carriers licensed in Maine that will file the certificate, and ask each to quote with the filing included. If you do not own a car, a non-owner SR-22 policy can carry the filing without insuring a specific vehicle. A few habits keep the filing intact:
- Pay the term in full or set up automatic payments so a missed bill cannot cancel the policy.
- If you change insurers, have the new carrier file before the old policy ends.
- Keep the BMV's demand letter; it is the document that states when your three years began.
- Ask your insurer to confirm in writing that the SR-22 was accepted, not just sent.
If the policy cancels
When a certified policy ends, the insurer files the SR-26, the notice of cancellation or termination. At that point the BMV no longer has proof of financial responsibility on file, and because reinstatement depends on that proof, your license is at risk until a new certificate is filed. Expect to repeat the reinstatement process, so a gap of a few days is far cheaper to prevent than to fix.
Bottom line: in Maine, the SR-22 is the insurer's certificate that satisfies 29-A M.R.S. section 1605, demanded under section 1603 after a repeat OUI, an accident suspension, or an unpaid judgment, and kept for at least three years after reinstatement. Have your carrier file it online, keep the policy continuously in force, and confirm your own dates with the BMV rather than with a generic rule.
Frequently asked questions
- Does a first OUI in Maine require an SR-22?
- The statute keys the OUI trigger to a prior conviction within a 10-year period: 29-A M.R.S. sections 1603 and 2487 bar reinstatement until proof of financial responsibility is filed when there is an OUI within that window. A first offense with no prior is not named there, so ask the BMV whether a filing is being demanded in your case.
- How long is an SR-22 required in Maine?
- Section 1603 says a person shall maintain proof of financial responsibility for at least three years after reinstatement, and the Secretary of State may waive the demand after three years from the date of demand. Your suspension notice states your own dates.
- How do I file an SR-22 in Maine?
- Your insurance company files it, not you. The BMV directs carriers to file online at tylerinsurancefilings.com, which it says is accepted faster than the older fax process. Ask the insurer to confirm the filing was accepted.
- What coverage does an SR-22 policy need in Maine?
- At least Maine's minimums under section 1605: $50,000 per person and $100,000 per accident for bodily injury, $25,000 for property damage, $2,000 in medical payments coverage, and $500 for towing and storage charges.
- What does the Maine BMV charge for SR-22 paperwork?
- The BMV's page lists $5 for a copy of the letter showing your requirement or judgment suspension and $2 more to have it faxed back, payable to Secretary of State. It lists no fee for the filing itself; your insurer may charge its own fee, so ask.
